30A Homeaway strives to provide you with an exceptional stay, free of hassles and stress. While your vacation is our main concern, understanding and adhering to our policies will guarantee your stay to be as fabulous as you dreamed it would be.
We would like you to take the time to read over and understand our expanded Your Vacation Rental Policies.
Administration Fee
 An administration fee will be added to each reservation for processing and is non-refundable upon cancellation. 
Advance Reservations
Reservations can be made up to one (1) year in advance, however rates and properties are not guaranteed. Rates and properties are subject to change without notice. A minimum payment of fifty (50) percent down per reservation is required at the time of booking the reservation.
The advance payment is not a damage deposit.

Last Minute Reservation
The full payment is required at the time of booking for all reservations made within 30 days from arrival.  You may either express mail a cashier’s check or money order, or use your credit card on file at the time you make the reservation. Cancellations for last minute reservations will be treated the same as all other cancellations
Taxes
A total of 12% tax will be collected on all rentals located in Walton County.
Age Requirement
30A Homeaway' customary policy is no reservations will be made to students or singles under the age of twenty-five. 30A HomeAway may approve, at the time of reservation and at our discretion, to rent to groups, but you must disclose at the time of reservation:
a. that you are a non-family group; and
b. the majority of the group members must be at least 25 years of age; or
c. if you are a family group, that there will be no more than five (5) children (under 17 years of age) to each (1) adult over the age of 25 staying at the property.
For Spring Break information and booking requirements, Parents must accompany their children under the age of eighteen at all times. Non-compliance of these rules and regulations will result in immediate eviction with no return of any and all funds paid.
It is 30A HomeAway’ policy that any reservations made under false pretense are null and void and check-in will not be allowed or if discovered after check-in, will subject the entire group to immediate eviction and forfeiture of all payments. This policy includes reservations made by parents or guardians who do not check in, and/or who leave overnight during the length of the stay. Additionally, be advised that 30A HomeAway considers any groups that violate this policy are injuring the reputation, dignity, or standing of the establishment, will result in immediate eviction with no return of any and all funds paid. You, or any one of your party’s failure to vacate the property immediately upon our notifying you that we no longer desire to entertain you and request that you immediately depart from the establishment may result in your being found guilty of a misdemeanor under the laws of this state under Florida State Statutes 509.141.

Occupancy
All of our properties list maximum sleeping availability to maintain appropriate comfort (listed as "Sleeps" on the webpage) and property integrity. Any excess must be approved, or persons may incur additional expenses and/or possible eviction. 30A Homeaway Representatives are eager to assist in helping you find the most suited vacation rental for your family.
Maximum Occupancy
30A HomeAway has set and published occupancy & parking limits for every Property and strictly enforces these limits. The Maximum Occupancy is determined by the bedding provided in the Rental Property and/or the limit set by 30A HomeAway. Exceeding the maximum occupancy will subject the entire group to immediate eviction and forfeiture of all payments.
Cancellation
You may cancel up to sixty (60) days after your original booking date and receive a full refund, less the administration fee and applicable taxes.  30A Homeaway does not issue any refunds for cancellations made more than sixty (60) days from the booking date. If you should have to cancel your reservation, please notify us immediately, and if you purchased the Vacation Rental Insurance contact your insurance to begin your claim.  No refunds will be made in the event of a mandatory evacuation if a guest does not purchase travel insurance.
Check-In Time
Check-In is begins at 4:01 P.M. or later. Due to our high standard of cleanliness, there is a possibility that your vacation rental may not be ready at 4:01 P.M. especially during peak seasons. Entering or parking at the property is subject to an additional fee of $250.
*** Please know your check-in can be extended due to the current pandemic and the additional cleaning and sanitization guidelines we are currently under.
Check-Out Time
Check-Out time is promptly 9:59 A.M. To avoid an extra cleaning charge; please start the dishwasher, take out the trash, and leave the property in a neat and orderly condition.
Late Arrivals or Early Departures
Refunds will not be given for late arrivals or early departures..
Check-In Early or Check-Out Late
We do not accept early check-in or late check-out requests during peak seasons.
Minimum Night Stay
Our properties require a minimum stay of three (3) nights (during off season). Longer minimum stays may be required during peak seasons or holiday periods. If a rental is taken for less than the required minimum stay, you will be charged the minimum stay rate. However, this is subject to each property and availability.  Please contact one of 30A Homeaway representative with your exact dates.
Method of Payment
When making reservations thirty (30) days or more in advance, the method of payment is by credit card (MasterCard, Visa, American Express, or Discover Card) for the reservation deposit. Remember that your final payment is due thirty (30) days prior to arrival. We will gladly accept personal checks for final payment if we have at least thirty (30) days to process the check. Accepted forms of payment are in U.S. funds only. For reservations made less than thirty (30) days prior to arrival, immediate payment in full is required by credit card (MasterCard, Visa, American Express, or Discover Card).
Pet Policy
No Pets
Pets are only permitted in designated 30A HomeAway accommodations.
30A HomeAway must approve all pets and a $150 per pet non-refundable. pet fee will be added to the reservation.
Guests who violate this policy

     1- will be charged an additional $500, plus the expense of any necessary cleaning.
     2- Violations may also result in immediate eviction and forfeiture of rent.


Dog Friendly Rental Policy:
For those homes which accept dogs, a $200 non-refundable dog fee is due with your final balance payment.

30A HomeAway Vacation Homes has a select few homes that will accommodate your furry (dog) family members. Pets of any kind are NOT allowed at any property unless the home is described as "Dog Friendly with Fee" and you have notified 30A HomeAway for approval. Homes will state in the property description as “Dog Friendly," if the property will accept dogs under The following listed restrictions.
  • Dogs are limited to 2 domestic adult small breed only (under 25 lbs.), housebroken & well-behaved (Additional Pets: $100 per pet, depending on the home)
  • Dog must be crate trained and crated when left alone in the property.
  • A $500 fee PER PET will be assessed if pets are found to have been in the rental property without authorization or if the pet exceeded the documented weight.
  • Boarding references are to be available upon request.
  • Violation of this stipulation is grounds for instant eviction without reimbursement.
  • Guest assumes all responsibility for additional cleaning costs, damages, pest services & replacement items due to pet.
  • Most rental agreements with our owners strictly prohibit pets of any kind.
  • Visiting pets are not allowed.
  • The fact that a property is promoted as a “Non-Pet Friendly” home does not guarantee that an animal has never stayed in the home.
Smoking
No Smoking or Vaping in Vacation Rental:
Smoking/vaping of any substance is strictly prohibited inside the Vacation Rental and Guests agree not to smoke/vape inside or within 50 feet of open doors and windows of the Vacation Rental, or neighboring properties.  Any Guest smoking in a non-smoking property will subject the entire group to immediate eviction and forfeiture of all payments. Guest will be responsible for all costs to remove the smoking odor from within Vacation Rental, and any other damages incurred.  A fine of $1,000 will also be strictly enforced.

Cleaniness, Maintenance, and Repairs
The Property will be inspected prior to The Rental Period to ensure that there is no need for maintenance or repairs.
Guest must report any deficiencies in the accommodation within 24 hours of arrival. A report can be made via phone or email, prior to guest departure. Responses shall be made in a time frame and to the degree deemed appropriate in the sole discretion of The Management Company, absent negligence on the part of The Management Company, faulty equipment, appliances, or services; bugs inside The Property; construction noise, a warm refrigerator, or inclement weather, and other similar complaints do not constitute breach of contract. Additional housekeeping service is available upon request. Upon departure, you must wash the dishes, place garbage in receptacles for pickup and place bed linens in a pile in each bedroom. The Management Company will charge the guest a minimum cleaning fee of $500 and up to the total cost of additional cleaning for accommodations that have been dirtied or soiled beyond reasonable guest use. The guest will be responsible for any damages, missing items and repairs of the home. A full inspection of the home will be conducted within 24 hours after check-out. The guest must report any theft or damage to the unit or its contents to staff upon discovery. Any damage found will incur a minimum charge of $250 up to the full cost of repair and will be applied to the credit card provided upon check-in.

Parking
 
Elevators/Fireplaces
Residential elevators and fireplaces located in private homes are NOT available for guest use. Elevators offered in common areas in condo complexes are available to all guests. Please contact an 30A Homeaway representative for specific property details.
Pool Heating
Some rental properties are equipped with pool heaters and may be heated for an additional charge between May 1st to October 31st. This service must be requested through our 30A Homeaway representatives department. Pools must be heated for the entire duration of stay and fees vary by property.  Pool heat must be ordered at least 72 hours prior to arrival.  Beginning from November 1st to April 30s this service will be provided as complimentary amenity (No Charge).
Waste Pick-Up and Removal
Guests should place all bagged trash on the property into the bins/containers along the side of the home, throughout the duration of stay and leave the bins on the front of the home for designated pickup. Recycling is picked up on Wednesday and regular trash is picked up on Monday and Thursday. A $50.00 fee will be charged for any un-bagged trash left outside the containers.
Substitute of the Rental Property
On occasion, the accommodations reserved become unavailable, for example due to the sale of the property. 30A HomeAway reserves the right to substitute comparable or better accommodations without notice or liability in the event the reserved property becomes unavailable (at no additional cost to you).  If a comparable or better property is not available, 30A HomeAway reserves the right to substitute another of our available properties, with appropriate reduction in rent. If no other property is available, Paradise Beach Rentals’ sole liability is to refund the total rents paid.  30A HomeAway will make every attempt to notify you as soon as possible if substitution must be made.
Security Deposit Policy
Security deposits will be charged to your credit card on file (Visa/ MasterCard/ American Express/ Discover), 7 days prior to check-in and will be refunded within 14 days from the date of departure and after verification with Paradise Beach Rentals that there are no additional charges due to property damage, lost/damaged linens, excessive cleaning, or damaged/missing bikes/beach chairs (if applicable). A credit card number must be provided for any damages above the security deposit amount.  30A HomeAway’ inspectors walk through each unit after check-out to insure the property is left in good order.  If a fee is charged, an explanation will be provided, along with photos of the damage. Any theft of items will also be deducted from the security deposit. Security Deposits vary by property. All security deposits will be held in escrow account. 
LDW (Limited Damage Waver)
30A HomeAway reservations require guest to pay a non-refundable Accidental Damage Repair Service which is a one-time charge per reservation that covers accidental damage. The Limited Damage Waiver is ONLY valid if the incident is reported PRIOR TO CHECK OUT. (It will become void upon departure. If it is determined that the damage was not caused by accident and was the result of inappropriate action resulting in negligence, the guest is then responsible for all damages. For example, if you accidentally spill something on the carpet or bedspread this would cover the cleaning.  If you carelessly/recklessly damage something in the unit or do not report damage as it occurs, the damage will not be covered by the LDW. You may also opt to pay a $750.00 damage deposit however, should any type of damage (accidental, careless or reckless) transpire, the charge/s for repair or replacement of damages will be billed and charged to the credit card on file for your reservation.)

Damage to the Property:
This fee pays for unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The cost of this program varies by property, for paying up to $2,000 of unintentional damage. This pays for accidental damages that are reported prior to checkout. Any damages that exceed the $1000 will be charged to the credit card on file that you provided.  As well as damages from negligence or wanton acts.

Conditions & Limitations: 
The Accidental Damage Repair Service Waiver has certain conditions, limitations, and exclusions.  This will NOT WAIVE the guest’s liability for damage or theft resulting from: 
  1. Acts of God
  2. Intentional acts or omissions, abuse or neglect by a guest or a guest’s invitee.  This includes any damages to the Property that could have been foreseen by a reasonable person including damages resulting in any additional cleaning and/or maintenance costs.
  3. Gross negligence which, for the purposes of this Agreement, shall be defined as an act by a guest or a guest’s invitee in reckless, willful or without disregard as to the consequences to the Property. 
  4. Any cause, if the guest does not report the damage immediately to Company staff prior to checking out of the Property.
  5. Normal wear and tear
  6. Theft that results from guest’s failure to lock or secure the premises or property, including items such as bikes.
  7. Damages, additional cleaning costs or additional maintenance costs caused by an animal allowed on or in the property by guest or guest’s invitee, including any service or emotional support animals.
  8. Damages resulting from unauthorized smoking on or in a property by guest or guest’s invitee.
  9. Damage to a golf cart provided with the rental property.
  10. This Damage Repair Service does not cover loss of use of the property.
  11. This Service does not apply for theft or damage of any property owned by or brought onto the premises by a guest or guest’s invitee.
  12. Property damage resulting from any motorized vehicle or watercraft operated by a The Plan applies only to the direct physical loss or damage to covered property.  It does not cover loss of use of such property.
This Service is not intended in any way to provide reimbursement or coverage for the following items, which shall remain the responsibility of the owner of the Property:
  1. Damages that constitute normal wear and tear.
  2. Damages resulting from acts of God, including but not limited to acts resulting in fire, flood, or other natural disasters.
  3. Damages or losses to Property that are unrelated to the actions of the guest.
  4. Theft that occurs despite the guests’ reasonable efforts to secure the Property and related items. 

Procedures: 
When a guest provides notice to our Company prior to check-out of accidental or inadvertent damage to the Property, the Company will investigate the damage to determine whether the damage appears to have been caused by accidental or inadvertent actions, and to determine the nature and extent of the damages and the necessity for and costs of the repairs or replacements. Such determination shall be made in the sole and absolute discretion of the Company provided there is some reasonable basis for making such a determination. The Company has ultimate claim administration authority, and in the event of any dispute relating to this waiver. Guests agree to submit to binding arbitration in Walton County, Florida.

Hurricane Evacuation
Construction near your property
30A HomeAway represents growing communities and there is a chance that your property may be near or next to some construction.  30A Homeaway cannot predict construction plans in the area and therefore cannot be held responsible for any inconvenience. Noise and altered views due to construction are beyond our control. If noise is excessive, you may notify 30A HomeAway and we can attempt to contact the contractor/builder. 
Refunds, additional discounts, substitutions, or cancellations cannot be made due to nearby/next door construction.

Maintenance
During your stay, promptly report any maintenance problems to 30A HomeAway. No refund or rate adjustment will be made for unforeseen failures such as the supply of electricity, water, pool filtration systems, air conditioning, telephone, television or cable service, appliances, etc....
Housekeeping Fee
A housekeeping fee will be added to all reservations, regardless of the number of nights booked. The fee varies depending on the size of the property and is applied to cleaning, laundry, and start-up amenity costs. Guest vacation accommodations will be cleaned to our quality standards prior to arrival and after departure. You will be responsible for the cleaning of your property during your stay and for leaving the property in good condition at check-out. We respectfully request that you remember that you are staying in someone’s home during your vacation; please treat it with the care you would your own. If units are found abnormally dirty at check-out, additional charges will be charged to your credit card to assist in performing a deep clean of the property. Additional cleanings can be arranged during your stay for an additional fee if you prefer.
We ask our guests to:
     • Leave property in a neat and orderly condition.
    • Put dishes in the dishwasher.
    • Remove all garbage from the house and pool areas.

Linens/ Towels/ Supplies
30A HomeAway has provided you with the initial paper products, dish washing liquid, trash bags, laundry detergent and toiletries. We have also provided clean linens and towels in your rental property. It is your responsibility to launder them as needed. We do not provide daily housekeeping service.
PLEASE BRING YOUR OWN BEACH TOWELS AND BEACH BLANKETS. BATH TOWELS AND LINENS ARE NOT TO BE REMOVED FROM THE UNIT
.
Any lost or damaged linens will be charged to your credit card on file or taken out of your security deposit. Some cleaning supplies are provided. Please do not use white towels to remove make-up.  Black Make-up towels are provided for removing make-up.  Do not use white towels to remove sunbathing oils and bronzes or to wipe up spills or liquids (please use paper towels).  These actions will soil the white towels and make them unusable. In the event that the towel(s) are damaged and have to be disposed of, your credit card on file will be charged or the costs will be taken out of your security deposit.

Health Concerns
The Property has been inspected to ensure no bed bugs are present. If found during the Rental Period, their presence shall be presumed to have been caused by The Guest, who will in turn be responsible for the cost of treatment in accordance with the terms of this agreement, unless the Guest provides clear and convincing proof otherwise. The Guest may be placed in an alternative property if available.
The Management COMPANY’S Access to the Premises
The Management Company may enter the Premises as reasonably necessary for protection or inspection; for repairs or other services, or for any other emergency and with such notice as The Management Company, in its sole discretion, deems appropriate.  
Safe Use of the Premises
The Guest shall use the Premises and shall comply with all laws and rules affecting it. No fireworks, open flames, or inherently dangerous activities are permitted. Do not take any furniture outside. Do not tamper with any alarms or smoke detectors. Use the overhead stove fan when cooking to avoid accidental activation of smoke detector alarms. Do not disturb the quiet enjoyment of your neighbors.
Neighborhood Rules/ HOA
Many of our rental properties are located in mix-use neighborhoods that include both short-term guests and year-round residents and are controlled by a Homeowner’s Association and or Condominium Association. These associations have extremely strict rules that must be respected. Most violations warrant a fine that the guest will be responsible for paying. Many rental properties prohibit the onsite parking of recreational vehicles, personal watercraft (boats, trailers, jet skis, etc.) and/or restrict the number of motorized vehicles per rental unit.  Please note these restrictions as set forth on our website, relating to the property that you are reserving.
Fireworks and Firearms
The use of firearms and fireworks is strictly prohibited at all Paradise Beach Rentals properties.
Property Rules and Regulations
Most homes located in residential neighborhoods are controlled by Homeowner’s Associations. These Associations have rules that must be respected. Violations may warrant a fine that will be the guest’s responsibility, and in some cases, failure to comply may result in eviction.
Violating Agreement
Any violations of these terms and conditions of 30A HomeAway or the 30A HomeAway Rental Agreement will subject your entire group to immediate eviction and forfeiture of all payments. In addition, any damage done to the property during your stay will result in your credit card being charged for the cost of repair or replacement, at our sole discretion.
Policies & Rules
These Terms and Conditions are meant to protect our guests and homeowners alike. All guests, as well as owners are required to conform accordingly. Violators are subject to eviction and possible criminal charges according to Florida Statute 509.141.
Violation of these Terms and Conditions by the guest or any member of your party may result in additional charges, eviction and/or the forfeiture of advance payments of rent and/or imposition of charges to repair any damage. 30A HomeAway reserves the right to refuse future reservations to any guest who has violated these rental Policies and Rules in the past.

Personal Items
30A HomeAway will not be held responsible for acts of theft or vandalism or other damages to the guest’s personal items left in the Home. Neither 30A HomeAway, nor the owner is responsible for personal items left on the premises by guests upon departure.
Pirvacy and Illegal Downloading
The illegal distribution of copyright material including unauthorized peer-to-peer file sharing on 30A HomeAway owned, operated or maintained networks may subject guests to civil and criminal penalties under federal law. Guests who violate 30A HomeAway 's policy with respect to copyright infringement and illegal downloading will be subject to immediate eviction and up to a $5,000 fine.
No Subletting
The rental property may not be sublet. Your reservation is non-transferable.
Indemnification of Manager
Guest will defend, indemnify and hold 30A HomeAway, LLC (including its members, officers, and employees), harmless from any and all claims, liabilities, losses, costs and expenses (including, but not limited to, reasonable attorneys’ fees and costs of suit) incurred by 30A HomeAway, LLC as a result of or arising out of the breach of this Agreement by guest, except to the extent such claims, demands and actions arise from the negligence or willful misconduct of 30A HomeAway, LLC. The indemnified party shall promptly notify the indemnifying party of any such claim and shall, at the request and expense of the indemnifying party, cooperate in the investigation and defense of such claim.
Indemnification and Hold Harmless
By making a reservation, Guest agrees to indemnify and hold the property’s Owner and 30A HomeAway harmless from and against any liability arising from or related Guest’s use and occupancy of the Rental Property including, but not limited to any claim or liability for personal injury, accidents, loss, damage or theft of Guest’s personal property which is made, incurred or sustained by guest(s). By making a reservation, Guest further releases, waives, discharges and covenants not to sue the property’s Owner, 30A HomeAway, its officers, staff, agents, or employees for any liability, claim and or cause of action arising from or related Guest’s use and occupancy of the Rental Property including, but not limited to any claim or liability for personal injury, accidents, loss, damage or theft of Guest’s personal property.
Agency Disclosure
30A HomeAway serves as the Agent & representative of all owners of vacation properties in its rental program, and is acting at all times, in and for the best interests of the owners. Guest acknowledges that Owner of Rental Property may be a licensed Real Estate Agent.
Swimming Pool and Hot Tub Usage - Release of Liability, Waiver of Claims, Express Assumption of Risk and Indemnity Agreement
In consideration for receiving access and/or permission to use any swimming pool, spa or hot tub (“Activity”) at your rental Property or otherwise made available to you as an amenity in conjunction with your rental by 30A HomeAway, LLC and the Owner(s) of your rental Property (“Owners”), you hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS for any and all purposes 30A HomeAway, LLC, Owners, and their respective officers, servants, agents, volunteers, or employees (herein collectively referred to as RELEASES) FROM ANY AND ALL LIABILITIES, RESPONSIBILITIES, CLAIMS, DEMANDS, CAUSES OF ACTION OR INJURY, INCLUDING DEATH, that may be sustained by you or your guests or invitees while participating in such ACTIVITY, whether caused by RELEASES’ active or passive negligence.
  1. You agree that you are fully aware that there are inherent risks involved with ACTIVITY, including but not limited to possible physical injury (including, but not limited to broken bones, strains, sprains, bruises, concussions, heart attack, heat exhaustion) and loss of life and you choose to voluntarily participate in said ACTIVITY with full knowledge that said ACTIVITY may be hazardous to you, your guests, your invitees, and your property (“You”). YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL OR EMOTIONAL INJURY, INCLUDING DEATH, that may be sustained by You as a result of participating in said ACTIVITY, whether supervised or unsupervised. You further agree to indemnify and hold harmless the RELEASES for any loss, liability, judgment, settlement, damage or costs, including court costs and attorney’s fees for both the trial and appellate levels that may occur as a result of or in any way related to Your participation in said ACTIVITY, whether caused by RELEASES’ active or passive negligence or otherwise.
  2. You agree to be responsible for the day-to-day general safety conditions of any swimming pool and/or hot tub to use at your rental Property. This includes, but is not limited to, keeping the swimming pool, spa and/or hot tub clean of debris, keeping the swimming pool, spa and/or hot tub areas clean, neat and organized, keeping all gates and doors locked and the swimming pool, spa and/or hot tub area secured at all times, and operating the swimming pool, spa and/or hot tub in a safe, responsible manner.
  3. You understand that RELEASES may not maintain any insurance policy covering any circumstance arising from your participation in this  ACTIVITY  or any event related to that participation. As such, you are aware that you should review Your personal insurance coverage.
  4. You hereby certify that you are at least 25 years of age and you are legally competent to enter into this Agreement, including the Release, Waiver, Assumption, and Indemnity provisions contained herein. You agree that it is your express intent that this release shall bind the members of your family and spouse if you are alive, and your heirs, assigns and personal representatives, if you are deceased, and shall be governed by the laws of the State of Florida.
Indemnification
Guest will defend, indemnify and hold 30A HomeAway, LLC (including its members, officers, and employees), harmless from any and all claims, liabilities, losses, costs and expenses (including, but not limited to, reasonable attorneys’ fees and costs of suit) incurred by 30A HomeAway, LLC as a result of or arising out of the breach of this Agreement by guest, except to the extent such claims, demands and actions arise from the negligence or willful misconduct of 30A HomeAway, LLC. The indemnified party shall promptly notify the indemnifying party of any such claim and shall, at the request and expense of the indemnifying party, cooperate in the investigation and defense of such claim.

Governing Law
This Agreement shall be enforced under the laws of the State of Florida and represents the entire Agreement.  Any amendments must be in writing and signed by both parties.  In the event of a dispute, legal action may only be instituted in a court of competent jurisdiction, located in the County within which the Rental Property is locate
Severability
If any term or provision of this Agreement is held illegal, invalid, or unenforceable, such illegality, invalidity or unenforce ability shall not affect the legality, validity or enforce ability of the remainder of this Agreement.
Authorized Signature
Through your electronic signature , you agree you have read, understand, and agree to abide by the terms of this Rental Agreement, which includes the above Reservation Details and the below Policies and Conditions, Peace of Mind Protection Plan Accidental Damage Waiver Addendum, Golf Cart Liability Waiver, Swimming Pool Liability Waiver, and Bike Liability Waiver and Damage Addendum (collectively the “Agreement”), and agree to rent the property set forth above for the period and price specified above. You further understand and consent to the use of the credit card or electronic check payments you provided in conjunction with this Agreement. You also authorize 30A HomeAway, LLC (“30A HomeAway” or “Manager”) to charge your credit card or checking account for any damages or fees consistent with this Agreement, and/or for the deposit, balance due, and any additional charges incurred during your rental period. You understand this authorization cannot be revoked and will not terminate until 30 days after the rental property is vacated.

 Golf Cart and Bike Liability.
By signing the Rental Agreement electronically and accepting the terms and conditions attached thereto, Guests who rent units that provide complimentary Golf Carts and/or bikes further consent to the express terms, conditions, and waivers set forth in the attached Golf Cart Waiver and Damage Addendum and Bike Waiver and Damage Addendum, the terms and conditions of which are expressly incorporated herein.

Guests agree to submit to binding arbitration in Walton County, Florida. Bike Liability Waiver & Damage Addendum The following terms apply to the use of any complementary bicycles and related biking equipment provided at one of 30A HomeAway’ Rental Properties:


1.  The person responsible for renting through 30A HomeAway, LLC (who executes this Rental Agreement via their electronic signature) (hereinafter
   "Operator") assumes complete liability for the care of and use of any complimentary bicycles provided during their stay and assumes full liability
     and responsibility for ensuring adherence to the rules and safety information provided herein.


2.  Operator expressly acknowledges and agrees that operating a bicycle involves the risk of serious bodily injury or death, and/or property damage
     and hereby assumes such risk knowingly and voluntarily.


3.  In consideration of being permitted to ride the bicycles provided, Operator does for themselves, their guests, their heirs, executors, administrators, and
     assigns, hereby release and forever discharge 30A HomeAway, LLC, 30A HomeAway, LLC's owners, agents, employees and assigns, as well as the
     Owners of the rental property and their assigns, from any and every claim, demand, action or right of action of whatever kind or nature, either in law
      or in equity, arising from or by reason of any bodily injury or personal injuries, known or unknown, death or property damage resulting, or to result,
      from any accident that may occur and any activities in the operation of the bicycles whether by negligence or otherwise that result in injury or damage.


4.  Operator also hereby indemnifies and holds harmless 30A HomeAway, LLC,  its owners,  agents, employees, and assigns, as well as the Owners of the
       rental property and their assigns, from and against any claims or suits made or filed by anyone who rides the bicycles provided to Operator through
      this Rental Agreement.

 
5.
  Rules of the road apply when bicycles are being ridden. Guests will obey all local, state, and federal regulations regarding the operation of this
      equipment on public traffic ways, parking lots, and in public areas, including but not limited to:

           a.  A bicycle rider or passenger (including a child who is riding in a trailer or semitrailer attached to a bicycle) who is under 16 years of age must wear
                 a bicycle helmet that is properly fitted and is fastened securely upon the passenger’s head. Each property is outfitted with free helmets for the
                 number of adult and children’s bicycles provided. If you do not have enough helmets upon your arrival, call 30A Luxury Vacation's office and we
                 will deliver additional helmets immediately.

           b.  Children under 4 years of age, or who weigh 40 pounds or less, must be in a seat or carrier that is designed to carry a child of that age or size  and
                that secures and protects the child from the moving parts of the bicycle.

           c.  A bicycle rider may not allow a passenger to remain in a child seat or carrier on a bicycle when the rider is not in immediate control of the bicycle.
           d.  Please always ride in the lane marked for bicycle use if one is available.
           e.  Because the bicycles provided are not equipped with the statutorily required lighting sufficient to allow riding in the dark, no riding between
                sunset  and sunrise is permitted.


6.  Parents and guardians are responsible for ensuring that your minor children are in compliance with these safety guidelines.

7.  Operator agrees to properly secure the bicycles at all times to avoid theft, damage, or unauthorized use. This includes ensuring that all bikes are locked
     and properly secured when they are ridden to another location. Every bike should come with a lock. In the event you don’t have sufficient locks to
     secure the bikes, please let us know immediately. If a bike is lost during your stay or stolen while the bike is not secured with a lock, your credit card or
     checking account on file will be charged for the replacement cost of each lost or stolen bike which is currently $450.00.


8.  Operator agrees that the bicycles will only be left at his/her rental property overnight and not at any other locations.

 Accidental Damage Protection Guests of 30A HomeAway, LLC ("the Company") who have paid the non-refundable $69.00 Accidental Damage Protection fee prior to checking in to a property ("the Property"), will not be obligated to pay the first $1,000 in damages, subject to the conditions and limitations set forth below.  This accidental damage protection is not insurance.  It is a non-refundable, one-time charge per reservation that covers accidental damage reported by the guest prior to check-out for guests who have complied with the Rental Agreement. In exchange for the payment of the Accidental Damage Protection fee and the execution of this Rental Agreement, which incorporates the terms of this limited Accidental Damage Protection clause, the Company hereby waives the right to charge the guest for any reported damages to the Property that result from the guests' accidental or inadvertent acts or omissions during the duration of their stay for damages up to but not exceeding $3,000.
Guests will be responsible for any damages or losses in excess of $3,000, as well as any damages or losses excluded from the terms herein.
Accidental Damage Protection Conditions & Limitations The Accidental Damage Protection clause has certain conditions, limitations, and exclusions. This clause will not waive the guest's liability for damage to the Property resulting from:
1. Intentional acts or omissions, abuse, or neglect by a guest or a guest's invitee. This includes any damages to the property that could have been foreseen by a reasonable person including damages resulting in any additional cleaning and/or maintenance costs.
2. Gross negligence, which, for the purposes of this Agreement, shall be defined as an act by a guest or a guest's invitee in reckless, willful, or wanton disregard as to the consequences to the Property.
3. Any cause, if the guest does not report the damage immediately to Company staff prior to checking out of the Property;
4. Theft when the guests failed to lock or secure the premises or property, including items such as bikes.
5. Any damages caused by an animal or damages resulting from unauthorized smoking in a unit.
6. Loss or Damage in excess of $1,000.
7. Loss or Damage to any of guest's personal property.
The Plan applies only to the direct physical loss or damage to covered property. It does not cover the loss of use of such property. This waiver is not intended in any way to provide reimbursement or coverage for the following items, which shall remain the responsibility of the owner of the Property:1. Damages that constitute normal wear and tear.
2. Damages resulting from acts of God, including but not limited to acts resulting in fire, flood, or other natural disasters.
3. Damages or losses to Property, which are unrelated to the actions of the guest.
4. Theft that occurs despite the guests' reasonable efforts to secure the Property and related items.
Procedures When a guest provides notice to Company prior to check-out of accidental or inadvertent damage to the Property, the Company will investigate the damage to determine whether the damage appears to have been caused by accidental or inadvertent actions and to determine the nature and extent of the damages and the necessity for and costs of the repairs or replacements. Such determination shall be made in the sole and absolute discretion of the Company provided there is some reasonable basis for making such a determination. The Company has ultimate claim administration authority, and in the event of any dispute relating to this waiver,

Beach Access and Boardwalks
Our area is prone to hurricanes which may change the topography in many areas from year to year. Therefore, 30A HomeAway does not advertise "Beach Access". Steps, docks, and boardwalks may be missing or may not be replaced due to storm damage. The Department of Environmental Protection sometimes prohibits the reconstruction of steps in narrow beach areas. When you make your reservation, please ask your 30A Homeaway representative for beach access information from your beach home or condo. Likewise, the photos on the website may not accurately reflect the design of oceanfront steps, boardwalks, dune decks, docks, or gazebos.
 
Beach Rules
Please make every effort to keep our beaches beautiful. Remove all umbrellas, chairs, and toys from the beach each day. Items left on the beach one hour after sunset or placed on the beach one hour from sunrise will be removed by Code Enforcement and may not be recoverable. Many beaches do not permit the use of tents larger than 6’x6’.  Please consult the beach attendant or signage for additional regulations. Observe the warning flags posted at every public access for your safety.
 
Beach Service
For select properties, complimentary beach service is provided seasonally between March and October, weather permitting. This service includes two beach chairs and one umbrella (unless noted otherwise) and is only offered during regular business hours until 5 PM.  Please contact a 30A Homeaway representative to determine availability.
 
Bicycle Service
Bicycle Service availability is seasonal and offered  through a third party vendor. Bicycles are the responsibility of the rental guest.



 


 

 
Golf Carts
Golf Carts are not permitted on public roads or highways. Advertised Golf Carts are not street legal and cannot be used outside designated associations. Per Florida Statute 320, the operator must be sixteen (16) years of age or older, and have a valid driver's license. If anyone is caught operating a golf cart under age, or without a license, the guest will lose the golf cart privileges. 30A Homeaway will not be held liable for any injuries, towing, ticket violations, or damages caused by the golf cart. Misuse of the golf cart is strictly prohibited - do not overload the cart or exceed maximum occupancy. The 30A Homeaway guest will be responsible for any and all damages that may occur while in their use. Please report any damages immediately to a guest services representative. Select communities and associations do not allow golf cart rentals. Check with an 30A Homeaway representative for further clarification.
 

 
Indemnification
By placing a reservation payment, Tenant understands and agrees to the following: 
 
Tenant understands and agrees that the Rental Property and Premises are owned by the Property Owners and not by 30A Homeaway and/or any of its agents, officers, directors, employees, members, affiliated companies or representatives (collectively, “Indemnities”). Tenant further understands and agrees that third party vendors have provided and may from time to time continue to provide services to the Rental Property and Premises or Activities for participation by tenants, including but not limited to beach service, bicycles, water sports, golf carts, workout facilities, in house dining, spa usage, and pool usage.  Tenant hereby expressly agrees and understands that Indemnities shall not be liable to Tenants for the acts or omissions of (i) the Property Owners, or (ii) third party vendors operating on or adjacent to the Rental Property and/or Premises, whether or not such vendors act pursuant to a contract with Indemnities, and Tenant hereby waives and releases all such claims against Indemnities to the greatest extent permitted by applicable law.  Tenant agrees to defend, indemnify and hold harmless Indemnities from and against any and all losses, damages to persons or property, injuries including but not limited to illnesses occurring during or subsequent to the tenancy, causes of action, claims, demands and/or expenses, including legal fees and expenses whether or not a lawsuit is filed and including legal fees and expenses on appeal (collectively, “losses”), of whatever kind or nature arising out of or on account of, or resulting from or related to use or occupancy of the Rental Property and/or Premises by Tenants and their invited guests.  The foregoing limitations on liability and indemnification obligations shall include, without limitation, any and all losses arising out of Indemnities own or sole negligent acts or omissions, except to the extent that such losses are caused by 30A Homeaway own gross negligence or willful misconduct.
 
Tenant further understands and agrees to defend, indemnify and hold harmless the Property Owners from and against any and all losses, of whatever kind or nature arising out of or on account of, or resulting from or related to (i) use or occupancy of the Rental Property and/or Premises by Tenants and their invited guests, and/or (ii) any act or omission of any third party vendor operating on the Rental Property and/or premises, except to the extent that such losses are caused by Property Owners’ own gross negligence or willful misconduct.
 
The provisions set forth in this paragraph shall survive the expiration or termination of this Agreement.
 
Internet Access
Privacy & terms usage for properties with internet access.  Users/guests may not use the internet access contained in or around 30A Homeaway Properties for malicious or unethical activity; including assessment of other people over the internet or that violate federal, provincial, or copyright laws.  This act in conjunction with the Digital Millennium Copyright Act.  Any and all misuse that is reported will be dealt with swiftly.  The guest that is listed on the reservation is ultimately responsible for the guest's/family member’s actions during the duration of their stay.
 

 

Neighborhood Rules/HOA
Most homes located in residential neighborhoods are controlled by a Home Owner Association. These associations have very strict rules that must be respected ie: limited parking, no commercial vehicles, no towels hanging from balconies, no golf cart rentals, garbage can retrieval, etc. Please contact an 30A Homeaway representative to insure compliance as most violations warrant a fine that the guest will be responsible for paying.
 
Noise Ordinance
Florida Statute 125.01 prohibits excessive noise at any time. Quiet time for all properties is 10:00 P.M. until 7:00 A.M., in conjunction with county ordinances. Please be considerate of your neighbors. Radios, stereos, and all other musical or entertainment devices will be played in compliance with the decibel level. The decibel levels cannot exceed fifty (50) decibels between the hours of 10:00 P.M. and 7:00 A.M. outdoors. Music played inside may not be heard outside of the property with the doors and windows closed. At 10:00 P.M., all guests not staying at the property need to depart from the premises.
 
Owner's Closet and Garages
Most properties have interior locked closets that are off limits to guests. Also, garages are considered "owner storage" and are off limits to the guest as well. Violation of this policy will result in additional charges under the Property Damage agreement.
 
Occupancy
All of our properties list maximum sleeping availability to maintain appropriate comfort (listed as "Sleeps" on the webpage) and property integrity. Any excess must be approved, or persons may incur additional expenses and/or possible eviction. 30A Homeaway Representatives are eager to assist in helping you find the most suited vacation rental for your family.
 
Peace of Mind Accident Protection
Your reservation includes our Peace of Mind Accident Protection, which comprises the 30A Homeaway administration fee and covers any accidental damages (up to $2,000.00) to the property throughout the duration of your stay. (Applies to reservations made after 1/1/2020)
 
At check-in, any present damage to the property must be reported within the first 24 hours. Any additional damage throughout the duration of your stay must be reported promptly to Ocean Reef Resorts when it occurs. Failure to report damage voids Peace of Mind Protection. Ocean Reef Resorts has the sole administrative authority of this policy and the exclusive right to determine the extent of repairs necessary as a consequence of the guest’s actions. This does not apply to damages caused by the intentional acts,  willful conduct or misconduct, gross negligence, or any instance of theft -Ocean Reef Resorts reserves the right to recover any damages resulting from any of the foregoing from guests. Ocean Reef Resorts is authorized to charge the card or cards on file for any damages suffered as a result of conduct or misconduct detailed in this paragraph.This does not apply to damages/losses caused by pets or other animals brought onto or into the rental property by guests. This does not apply to damages to, or loss of, property owned by or brought to the rental property by the guests. This does not apply to any damages or claim of loss as a result of loss of use of the rental property.
 
This does not apply to any damages or violations to association rules and regulations. This does not cover damages from events in which 20 or more people participate or are in attendance. Peace of Mind Accident Protection becomes effective only upon check-in to any Ocean Reef Resorts-managed property, and all the benefits of this policy terminate upon check-out at the end of the guest’s visit.
 
Security Systems
Please note that some Homes, Condominiums, and/or Common Areas may be equipped with security systems; e.g., onsite security, cameras, alarms, etc. For additional information, please ask a representative for details.
 
Smoke Detectors
All of our vacation rentals are equipped with smoke detectors.  If you are hearing impaired, a hearing impaired smoke detector can be provided upon request.
 
Pet Friendly Property
30A HomeAway has an inventory of pet friendly properties. Dogs (twenty-five pounds or less) are allowed at designated pet friendly properties only. While outside, pets must be on a leash at all times. A person with a pet must collect and properly dispose of all fecal matter. Any reservation made under false pretenses will be subject to forfeiture of any/all payments of rent and deposits, and the party will not be permitted to check in. If the party has already checked in, they will be evicted and subject to additional cleaning expenses. Pets are not permitted on the beach.
 
Pool, Hot Tub, & Spa Policies
As the renter, you agree that you will use the pool, hot tub and/or spa at your own risk, and that 30A HomeAway will not be held responsible for the injuries sustained by you or your fellow guests or party members when using the swimming pool, hot tub and/or spa.  You further agree that you will not permit any minor to swim in the pool, hot tub and/or spa unaccompanied by an adult. Pool heat is offered seasonally between October and Early May, however, pools cannot be heated if the temperature is below fifty two (52) degrees or above eighty (90) degrees. For an additional cost per day for most properties, the pool temperature will be set between eighty (80) and ninety (90) degrees. Pool Heat must be purchased for the entire/duration of stay and will be billed at the time of request. Please contact an 30A HomeAway representative for details on the additional cost. Allow forty-eight (48) hours for the pool heater to heat the pool water to the set temperature.  Hot Tubs in most rental homes are not operational unless designated in the property details. Homes offering a hot tub as an amenity may have restrictive times and additional fees associated. Please contact an Ocean Reef representative for additional information. 
 
Please Note: there are particular risks involved with using a pool, hot tubs, or spa. By using any pool, hot tub, or spa you put yourself at risk of possible airborne or waterborne pathogens. If you or anyone in your party are at high risk, please contact a physician prior to any use of a pool, hot tub or spa.  It is important to read the information below to familiarize yourself with safety policies pertaining to the pool, hot tub, or spa use. 
     •No lifeguard is on duty.  All persons who use the pool, hot tub, or spa do so at their own risk
    •No running, diving, or rough playing
    •No glass in the pool or hot tub area
    •No food allowed in the pool or hot tub
    •Enjoy the pool or hot tub from 7am to 10pm only
    •Proper swimwear required
    •Children in diapers must wear swim diapers at all times
    •Shower before entering the pool or hot tub
    •Do not swallow or ingest pool water
    •No animals allowed in the pool or hot tub     
    •Keep all doors and gates adjacent to the pool, hot tub or spa locked to prevent unauthorized entry or entry by unaccompanied minors.
    •Children under the age of 10 are prohibited from using the hot tub or spa
    •Elderly persons, pregnant women, infants and those with health conditions including but not limited to diabetes, heart disease, high or low blood pressure should consult a physician before entering a pool, hot tub, or spa
 
Tampering with pool equipment may result in injury and/or a fine.  All pool equipment must be operated by a licensed professional contracted by the property owner.
 
Community Pools
Community or condominium pools are not controlled or maintained by 30A HomeAway therefore 30A HomeAway cannot be held responsible for inconveniences resulting from the pool. Community Pool Heating is offered seasonally under the control of the managing associations. Dates may vary, contact an Ocean Reef Representative for more information. 
 
Property Damage
In order to provide our guests with the best vacation possible, we ask that all damages and/or maintenance items within the property be reported upon arrival to 30A HomeAway. Every effort will be made to correct items in a noninvasive, efficient manner. An active credit card is required to maintain the reservation and the integrity of the unit. By signing this agreement you waive your right to dispute any charges that are made to your credit card regarding this policy. Non-billing stipulations include:
 
    •No damage to the property or theft.
    •No violations of rental or association policies.
    •Rental is left in a neat and orderly condition.
    •All garbage is removed from the house and pool areas.
 
30A HomeAway will do everything within its means to notify you of impending charges; however, 30A HomeAway reserves the right to bill the credit card for violations to the policy. Any legal dispute of the damages will be contained to the State of Florida and the County in which the rental property resides.
 
Seasonal Guests
Any guests booked as a Seasonal Guest do not have access to any of the amenities provided by 30A HomeAway. Guests are required to pay one thousand dollars ($1000) within seven (7) days of booking and the first month's rent is due thirty (30) days prior to arrival. Each additional month must be paid thirty (30) days in advance.  Mailboxes are not provided, please contact the nearest post office for monthly PO box rentals.
 
Signature Form
At the time of reservation, a confirmation will be sent via email. The second page is the "Signature Form", please sign it within seven (7) days of the booking date. In the event the form is NOT received, your reservation will be cancelled and the deposit will be returned less the Administration Fee.
 

 
Special Events
Special events are not permitted at most properties; however please contact an 30A HomeAway reservationist for available properties. An additional deposit and/or fee may be required based upon the event and property. Please note some events require permits and/or approval from the association, it is the responsibility of the guest to contact the corresponding representatives to ensure compliance.
 
Rental Equipment/Furnishings
All vacation rental homes are privately owned properties furnished and equipped by its owner. As such, 30A HomeAway cannot make any changes to the furnishings or equipment provided by the owner. If you require special appliances or equipment, please bring them with you. Decor, style, and color will vary & furnishings are subject to change without notice. Under no circumstances are furniture, bedding, mattress pads, utensils or any other property supplied with the rental property to be taken out or transferred from one property to another; you will be charged to retrieve or replace rental home property that is removed from the home. Moving of furniture is prohibited; do not move furniture or otherwise remodel the home. You will be charged for the time it takes to move furniture and for any repairs of any damages caused by moving items.
 

 
Trailers, RV's, and Motorcycles
Trailers and RV's are not permitted at most of our properties due to homeowner associations and size. Also due to noise restrictions in some neighborhoods and resorts, Motorcycles may not be permitted. Please contact an 30A HomeAway representative for properties that allow them. Guest vehicles, trailers, and RV's are not authorized to park at 30A HomeAway' properties. To arrange for temporary parking of vehicles, trailers, and RV's please contact seagrove mini Storage at 850-622-1748.
 
Trip Cancellation/Interruption Insurance (Travel Insurance)
Ocean Reef Resorts offers CSA travel cancellation/interruption insurance to every guest. CSA insurance is optional but is strongly recommended. Guest participation is accepted/denied via the "Signature Form" no less than 30 days prior to arrival. Please note that pre-existing health conditions may not be covered. No refunds will be made in the event of a mandatory evacuation if guest does not purchase CSA insurance. For questions concerning the travel insurance, please call CSA directly at 800-554-9839. The insurance premium is non-refundable and non-transferable.

Property Access/Service Policy 
30A HomeAway reserves the Right of Entry. Due to limited “turn-around” times through peak season, unit access may be required during your stay to maintain unit maintenance, real estate showings, and/or inspections. Ocean Reef will do our best to notify you of entry. Tenants are not required to be present.
